1. Scope and seller

These terms and conditions apply to all orders placed in the online shop balisaur.at. The seller is BALISAUR e.U., Arsenal 5/5/4, 1030 Vienna, Austria, email: hi@balisaur.at. Any deviating terms of the customer do not apply. The contract language is English.

2. Conclusion of contract

The products shown in the shop are not a binding offer but an invitation to order. By clicking the order button you place a binding order. You will receive an automatic email confirming receipt of your order; this is not yet an acceptance. The contract is concluded when we confirm the order separately or ship the goods. We may decline orders, for example if an item is no longer available.

3. Prices

All prices are in euros and are final prices. As a small business owner within the meaning of § 6(1)(27) of the Austrian VAT Act (UStG), we do not charge VAT, so no VAT is shown. Shipping costs are shown separately before you complete your order; see our Shipping Policy. For deliveries to countries outside the EU, import duties and taxes may apply and are payable by the customer.

4. Payment

You can pay with the payment methods offered at checkout. Payment is due when the order is placed.

5. Delivery

We ship to the countries listed at checkout. Information on shipping costs and delivery times can be found in our Shipping Policy. If an item is unexpectedly unavailable, we will inform you immediately and refund any payment already made.

6. Retention of title

The goods remain our property until paid in full.

7. Right of withdrawal

Consumers have a statutory right of withdrawal of 14 days. Details and the model withdrawal form can be found in our Withdrawal & Returns Policy.

8. Handmade character

Our pieces are shaped by hand and finished individually. Slight differences in form, surface and size compared to the product photos are part of the design and not a defect. Sterling silver naturally darkens over time; this patina is not a defect and can be removed with a silver polishing cloth.

9. Warranty

The statutory warranty rights apply (for consumers in Austria in particular the Consumer Warranty Act, VGG). The warranty period is two years from delivery. Please report defects to hi@balisaur.at.

10. Liability

We are liable without limitation for intent and gross negligence and for personal injury. In cases of slight negligence, our liability is excluded to the extent permitted by law. This does not affect liability under the Product Liability Act or mandatory consumer protection provisions.

11. Applicable law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence. For consumers resident in Austria, the court of their place of residence has jurisdiction.

12. Dispute resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board. If you have a complaint, please contact us directly at hi@balisaur.at.
